    Federal government and NSW government disability programs

    The Federal Government has recently completed its evaluation of the Disability Employment Services (DES) program and has made a number of observations and recommendations. In particular, it has recommended that several providers should lose their contracts due to poor performance. The review also commented that a number of providers “park” their most difficult jobseekers and deem them to be too difficult to place into open employment. It was also observed that a number of jobseekers only remained  in employment until the employer government subsidy expired and then the jobseekers were let go.

    The ‘parking’ and employers only taking on a jobseeker with disability until the subsidy runs out are not new phenomena as they have been occurring for many years in the DES program.

    The Federal Government has recently completed its evaluation of the Disability Employment Services (DES) program and has made a number of observations and recommendations.

Case Management Terms

Welcome to Toozly

The Case Management Terms below apply to your use of the Case Management System on Toozly. By accepting the Case Management Terms, You also accept the [Site Terms].

1. Access to Case Management System

1.1. You may utilise the Case Management System in consideration for the Fees.

1.2. You may access the Case Management System via the secure login and password which You provide to Toozly.

1.3. You may use the Case Management System solely on these Case Management Terms.

1.4. Access to the Case Management System is, in addition to the provisions of the Case Management Terms, subject to information made available on Toozly in respect of individual Case Management products.

2. Privacy

2.1. You acknowledge your obligations under the Privacy Act in respect of the Personal Information (including any Sensitive Information) of Your Clients and agree to comply with those obligations in respect of the Case Management System.

2.2. You warrant that, in respect of any Client Personal Information or related information, You have notified the relevant Client of your intention to utilise the Case Management System for the management of that Client’s case and have obtained each Client’s express written consent to the uploading and storage of and access to their Personal Information for that purpose.

2.3. You warrant that, prior to uploading any Client Personal Information or related information for publication on Toozly, that You have obtained the express consent of Your Client to do so in a form which complies with Your obligations under the Privacy Act.

2.4. If We so request, You will give Us a duplicate of any individual consent obtained by You under clause 2.2 or 2.3.

2.5. You agree to indemnify, defend and hold Us, our employees, contractors and agents harmless in respect of any and all third party claims, liability, damages and costs (including but not limited to legal expenses) arising either directly or indirectly from any breach by You of the provisions of clause 2.1, 2.2 and 2.3.

2.6. You consent to Us storing and retaining all data provided to Us by You through the Case Management System, including Your Personal Information and the Personal Information of Your Clients.

3. Availability

3.1. You acknowledge and agree that the Case Management System may not always be available and We may sometimes need to withdraw access to the Case Management System without notice to You.

4. Payment

4.1. Details of relevant Fee Payments and associated payment arrangements are set out on Toozly.

4.2. Case management packages will automatically renew annually. You may cancel such automatic renewal by logging in to your account and following the cancellation instructions within the period specified on Toozly.

5. Conflict

If there is any conflict between the provisions of these Case Management Terms and the Site Terms, the provisions of the Case Management Terms will prevail.

Definitions

Case Management System means the case management facilities on Toozly.

Client means any client of Yours in relation to whom You input data into the Case Management System.

Fees means the fees payable to access the Case Management System at the rates and for the services specified on Toozly.
